  1. Definition of Indemnity

By accessing and using Fortia.com (the “Portal”), you agree to indemnify, defend, and hold harmless the owners, founders, directors, hosts, employees, consultants, and legal associates (collectively referred to as the “Indemnified Parties”) from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees).

  1. Scope of Coverage

This indemnification applies to any claim arising from:

  • User Conduct: Your use of and access to the Portal, including any data or content transmitted or received by you.
  • Breach of Terms: Your violation of any term of the Privacy Policy, Disclaimer, or Confidentiality Agreement.
  • Third-Party Rights: Your violation of any third-party right, including without limitation any right of privacy, publicity rights, or Intellectual Property Rights.
  • Inaccurate Content: Any claim or damages that arise as a result of any of your user content or any information that is submitted via your account.
  • Technical Disruptions: Any loss caused by unauthorized access to our servers and/or any and all personal information stored therein.
  1. Safety and Security Protocol

The owners and hosts of Fortia.com act in good faith to provide a secure environment. However, the Portal shall not be held liable for any security breaches, data leaks, or “Acts of God” (Force Majeure) that occur despite standard industry-level security measures. Users interact with the Portal at their own risk.

  1. Dispute Resolution & Mutual Arbitration

In the event of any controversy, claim, or dispute arising out of or relating to the use of the Portal:

  • Consultation: The parties shall first attempt to resolve the matter through friendly and mutual consultation.
  • Arbitration: If the dispute is not resolved within thirty (30) days of such consultation, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended).
  • Process: The arbitration shall be conducted by a sole arbitrator mutually agreed upon by both parties. The language of the arbitration shall be English.
  1. Governing Law and Jurisdiction

This Indemnity Policy and all associated legal documentations of Fortia.com are governed by and construed in accordance with the laws of the Republic of India.

Exclusive Jurisdiction: You expressly agree that any legal proceedings, suits, or actions arising out of or in connection with Fortia.com shall be instituted exclusively in the Indian Judicial System under the jurisdiction of the Kolkata Courts only. 

  1. Survival of Policy

The obligations and provisions of this Indemnity Policy will survive the termination or expiration of your relationship with Fortia.com and your use of the Portal.
